These Terms of Service ("Terms") govern your access to and use of the Status Page service ("Service") operated by CloudSigma FZ-LLC ("CloudSigma", "we", "us", or "our"), a company registered in the United Arab Emirates.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • "Service" means the hosted status page platform, including all associated APIs, dashboards, notification systems, and related features provided by CloudSigma.
  • "Account" means the user account you create to access and manage the Service.
  • "Status Page" means a publicly accessible page that displays the operational status of your services, components, incidents, and maintenance windows.
  • "Subscriber" means any individual who subscribes to receive notifications from a Status Page.
  • "Content" means any data, text, images, logos, or other materials you upload to or create through the Service.

2. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Use of the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. You agree to use the Service only for lawful purposes and in compliance with our Acceptable Use Policy.

4. Your Content

You retain ownership of all Content you submit to the Service. By uploading Content, you grant us a worldwide, royalty-free, non-exclusive license to use, store, display, and distribute your Content solely as necessary to provide the Service. You represent that you have all rights necessary to grant this license.

5. Subscriber Data

If you collect subscriber information through the Service (email addresses, notification preferences), you are responsible for complying with all applicable privacy and data protection laws. You must not use subscriber data for purposes unrelated to status notifications without obtaining separate consent.

6. API Usage

The Service provides REST APIs for programmatic access. API keys are confidential and must be protected. You are responsible for all API activity under your keys. We reserve the right to rate-limit or suspend API access if usage patterns indicate abuse or excessive load.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. The Service is provided on an "as is" and "as available" basis.

8. Fees and Payment

The Service may offer free and paid tiers. If you subscribe to a paid plan, you agree to pay all applicable fees. Fees are non-refundable except as expressly stated otherwise. We reserve the right to modify pricing with 30 days' notice.

9. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is the intellectual property of CloudSigma FZ-LLC. Nothing in these Terms grants you any right to use our trademarks, logos, or brand assets without prior written consent.

10. Prohibited Conduct

You agree not to:

  • Use the Service to distribute malware, phishing content, or illegal material
  • Attempt to gain unauthorized access to the Service or other accounts
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell or redistribute the Service without authorization
  • Use the Service to send unsolicited communications (spam)
  • Interfere with or disrupt the integrity or performance of the Service

11. Termination

Either party may terminate these Terms at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases. We will make your data available for export for 30 days following termination, after which it may be permanently deleted.

12. Limitation of Liability

To the maximum extent permitted by applicable law, CloudSigma FZ-LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless CloudSigma FZ-LLC and its officers, employees, and agents from any claims, losses, or damages arising from your use of the Service, your Content, or your violation of these Terms.

14. Modifications

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
